I am in receipt of the complaint that you recently logged on the
consumer.complaints.org website, forwarded to this office as you reside in
Leicestershire.

Your rights in law are derived from your contract with the trader and are
outlined below.

Where your offer to purchase the goods at the price advertised has been
accepted, and the money debited from your credit card you have a legally
binding contract with the trader. If the trader does not supply the items as
agreed, within any specified time limits, they are in breach of contract for
non-delivery and you may sue them in the civil courts for compensation.

After a contract has been agreed, a trader may not change its terms of
without the specific agreement of the consumer. The price of the item you
have purchased is a term of your contract with the trader, the trader has no
right in law to demand a higher price than stated on the contract.

Ultimately, the trader is legally bound to supply you with the goods as
originally agreed if they do not you may seek compensation from the courts
.This includes a refund of your money and in addition compensation for 'loss
of bargain'. If after a reasonable search you are unable to find the same
item except at a higher price, you may recover the difference between £**.**
and the more expensive amount.

If the trader does not supply the goods, the correct forum for the
resolution of contractual disputes under £5000 is the small claims procedure
of the county court. The court can be contacted directly on 0116 222 2323
for a small claims pack. If you decide to take this action you must warn the
trader by email, fax of letter of your intention to do so.
