I had my car on ebay and a lass offerd me what i wanted so i ended it early she gave me the deposit. she said would u deliver it i said she i'll try sort summit out. obv derby isnt round the corner so she wud have to wait abit. couple days ago she said i can't wait any longer im going to try arange delivery for it i said fine ok long as u pay for it.
then i get a text saying that i couldnt wait any longer i've bought another car, she sent this on the monday and the car was due to go down on the wed/thurs. now im pissed off because i have £800 sitting on a corsa with a lad on my bk asking when im getting the rest of the money.

anyways i get an email couple days ago saying this.....

can u send my 300 bk as i dont feel u are intitled 2 keep it,it wasnt my fault i wanted the car and was waitin 2 weeks we arranged u would deliver if ud have said in the begining that u couldnt deliver then i wouldnt have put a dep on it. nowhere does it say dep is non refundable but in any case im intitled 2 it back i will take the matter further if i dont get it back.

now im sorry but she backed out of the deal so y should i lose out, shes the one who backed out the deal.

im willing to take it further just wonderd what you thought.

help would be helpful.

if you agreed to deliver the car then you should of set upon doing such, but if she agreed to collect it its her own fault. as for the money a deposit is the same at any time and if she aint come up with the rest i would keep the money for timewasting

Well there is'nt much you can do is there really? You can keep hold of her £300 quid until she comes up to Norton with her brothers Phil & Grant, or you can give the £300 back and find another buyer?

just send her the money back, stick it back on ebay

put something in the ad like

"if you dont have more than 5 feedback score, i will not accept bids, thanks to *name of previous bidder*"

she is entitled to her deposit back, because you didnt say it was non refundable

even if you had said that, you'd still have to give it back

get it back up on ebay asap

sorry about the grammer lol, not in the mood to type in correct english.

i said to her that i will deliver it but it wouldnt be straight away.

now i've had to put the car back on ebay to get another buyer.

If you havent stated to her that the deposit she put down was none refunable then you have to give it back.

If your going to end an auction early state to the buyer that its collection only (saves hassle) and that a deposit is none refunable

She backed out of a deal she entered into.....by what seems because she couldnt pick up the car. Her loss id keep the cash!!

When you consider we just sold our Triumph to some people who drove all the way here to trailer it back to where they live in Germany, I'm sure she could have got hold of it if she really wanted to. Probably just decided she didnt really want it so is trying to worm out of it.

Deposit is a deposit, if you're BUYING something and you leave one, it's usually left to pay the balance on collection, only time I've heard of deposits being refundable really is when you're renting something and it's taken in case of damage. If it bugs you too much, offer her a settlement of half the deposit, so you keep £150 for the hassle it's caused you.

I know it's a ball ache but I would just give her the money back. It's £300 at the end of the day which is not worth the hassle it could cause in the long run.
