So annoyed!

Was a passenger in my mates car when a copper pulled us up, and said I was getting a fixed for not wearing a seatbelt.

After an initial friendly discussion, he wasnt giving in, so I have him an immense amount of arguent about legal definitions etc.

What I want to know is do they have to show you the evidence (ie the video which proves it?)

He wouldnt show me it and said he would in court, but other than that refused to show me it

I dont think they can do this, anyone else had this?

If you contest it and go to court then thats when they are obliged to show the evidence, and if found guilty you be made to pay court costs of at least £40 plus any fine they wish to give you (usually £60 when it comes to court) best thing is to pay it and forget about it

yeah I completely see what you mean, just thought I could get out of it on

a) a technicality (for not showing evidence)

b) the fact there is no evidence

Looking at the situation in which the incident occured, theres no way he could have recorded it on video,which is why he's reluctant to show it?

Who's been caught on here and been / hasn't been shown the evidence?

He didn't give you a fine for the hell of it, do you not see those adverts on TV about people that don't wear seatbelts?

if there is 2 coppers in the car thats all the evidence they need..

AND wear your seatbelt, i learned the hard way of not wearing my seatbelt all the time in the back..

My thoughts exactly sam with these adverts on the TV i can't believe fools are still not wearing there seat belts. On the flip side you could have proberbly come abck with the freedom of information act.

You're a 'locally respected young defence lawyer' PK1 are you not?
You can get people off of drink driving and 10k for whiplash yet your asking on here about not wearing a seatbelt

I'm very tempted to take it to court, however this could potentially result in a larger fine consequently I think i'll just pay the fine!

Suppose its not half as bad as the new parking fines! £70

Written statement would be enough as evidence, they don't need anything more. And you get costs for going.

yes, its £55 costs + the £30 fine

in all fairness though, its a seatbelt offence! These things don't get taken with much, if any, seriousness in the great scheme of things

As a driver is it just a fine still or points too?

I would say leaving the car via the front window or crushing the person in front of you is fairly serious.

i had one a while back and took it to court there said they where doing me for not wearing a seatbelt but was going to drop the fine so i didnt have to pay anything .but i still got done for no seatbelt just didnt get any punishment as they keep it on record if u get done again or something

should add i only took it off at the trafic lights due to kids argueing pulled off at the lights and was pulled almost straight away

Pay the fine, you're lucky you didn't crash and kill yourself for not wearing your belt. Takes 2 seconds to put on and comes naturual, feels weird when you don't wear it and the car is off lol!

pay it and next time have it on. On Friday night one of my close friends crashed, he and his passenger did not have seatbelts on.....he got out with minor cuts and a buggered up arm, she hit her face on the windscreen and is in a bit of a state.

i have to be honest it has taken me 4yrs to start wearing a seatbelt in the car after i had my crash it saved my life not having one on kinda scared me to wear one if you know what i mean but in all honesty the chances of it hapenning again are very slim i was lucky once plz wear ya seatbelt its not worth not wearing one in the long run
