Thats correct!! If you have a spare wheel it must have legal tread, but you dont have to have one.... so if you have a spare with illegal tread you will fail the MOT

most places dont even check them cos they are aware that you dont need to have one.

the spare doesnt have to be there and if it is there doesnt have to be legal or pumped up. it doesnt even have to be the right one for the car etc
