Proper shite having to tell insurance for 5 years!

I had 6 points cost 300-400 extra on group 20 cars

Ive found out theres a code of conduct for using them where if no ones on the site they should be operated by motion detectors & not timer (as Kif said!) I dont think its legally binding but might be enough to piss on their parade & get it thrown out?? Im going to give it a go anyway, i'll be fucked if im taking points for this!!

Traffic control by portable traffic signals
You can use portable traffic signals at most sites up to 300 metres long. Type Approved equipment must be used and should always be vehicle actuated except where otherwise instructed in writing by the highway authority. [Your supervisor must tell the highway authority when portable traffic signals are to be used. Approval in writing will be needed when the shuttle section includes a road junction.]

At some point it may be worth asking for, the fleet No of and type approval for the lights set up, and the written approval of the HA to use timed settings.

I'll keep looking for a primary legal source to find out if it's law, so far I've got a "code of practise, to enable compliance with the law"

I've done the training course for setting up temporary lights and that's where I was told "no timer when unattended".

Good luck contesting it. The highway code is not the law to driving btw.
