Right so a friend has just received a ticket after parking in the same place that was free for months and now it is privately owned! Now I've told him to not pay it after reading all the posts on here and he's looked into it and it says the company that have given him it aren't the council but they are team up with British parking association? What should he do?

Mines up from £90 to £256 now and that was just before Christmas, I'm not paying it but that is a little shady if that's the case now!

im talking about the guy who came on apparently from the trade that gave the info on the clio forum in the first place where chip got the info from and reposted it

Why would you need to tell a private company who was driving your car at a certain time? They have no right to this information - you wouldn't tell Walkers Crisps this info if they sent you a letter demanding it.

It always has been on the registered keeper hasn't it? Was it not always about the private companies not having the authority to enforce it like councils do?

My understanding is that when clamping was prohibited there was some legal guidance set that the onus was now on the registered keeper to identify the driver.

Im back in work tomorrow and will try and dig some stuff out

yes, afaik. as they're private, they are not at liberty to know who was driving the car at that time.

councils are though, so theres no getting out of those ones.

Before there was no onus on the registered keeper to actually identify the driver as the private company was merely a contractor for the land owner. But these rules have apparently changed I will look into it though

Could do with knowing this. It was down to tbe laws they fell in before, private was contractual law in which the registered keeper wasnt legally obliged to say who was driving, therefore no contract could be entered in. Civil law; police and parking attendants the registered keeper is obliged by law to say. That's how it worked before anyway
