Dealership, IMO, has a point here;

Though, they should still have some of the responsibility due to the fact someone from the dealer just used the remote start and not the conventional start.

There's no neutral detection on the key, and that doesn't cause me too much problem.

I'm surprised you can buy a kit like that without a neutral switch, unless it was bypassed, especially in America.

I thought they ALL had to have a switch so they will only start in N or P :/

I'm struggling to understand how they can blame it not having a safety device when it's a factory option? Bloody americans.

It's driver error, no different to starting the car in gear with a key, no excuse for it.

Sounds like the dealership just don't want to pay out, cheap bastards. They should pay it, it's their fault.

It's similar to saying:

"you owe me a new watch"
-"you told me it was waterproof, but you didn't say only to 5 meters, you should have it waterproof to 50 meters".

Ok. I admit there are probably better examples I could have used, but you get the idea. It's their fault for being stupid.
