Incident -
Guy in company van reversing down my road (this is normal for my road) trying to miss my neighbours car, swiped my front bumper resulting in damage. This was a couple of weeks ago, rang his boss who said sort it out privately (cash). Got a quote from Vaux (get a free courtesy car for the day) for £226 for a whole bumper respray etc. Now he is saying 'Ill get Malc (guy who hit the car) to come round as it sounds a lot of money for the damage he did'.
Now this is starting to piss me off, ive done the legwork and im getting nowhere and its only too long before I get arsey down the phone. Can I go through my insurance (I know the van reg plate, it lives down here) without having a black mark against my name?

IMO, one more POLITE call to the boss, give him the ultimatum:
Either he pays up the £226 (not really a lot of money) after you send him an estimate. Tell him you are saving him the hassle of insurance and his excess etc etc. Give him a deadline to make a decision, I.E. 7 days at the most.
If not, I think you have to get on to your insurance company, but then it's still logged as a "non-fault" accident.

I havent dared call yet, im letting my missus do it (she works in a call centre so is trained in such matters ). I didnt think it was a lot of money. I even photocopied the estimate and passed it to the guy who works for him 2 doors up, hes had it a few days. This Malc bloke is coming today so ill tell him

Dont claim on your own insurance... Phone your insurance company give them the number plate and they will be able to tell you who the other vehicle is insured with.. You can then phone their insurers directly. They have clearly admited liability as they have expressed interest in paying for the damages so all they need to do is confirm this with their insurers, they will send out someone to asess the damages. If they are happy with the quote you had they will authorise the repairs and pay them directly.

Whether it was your fault or not, if you claim you'll lose your NCB unless your insurance provider does schemes like Churchill/Direct Line.

You dont lose you NCB if your not at fault, The person at fault does.

no, as your still claiming off the other person company..
your insurace basically does all the comunitcation with them
still not a non-fault claim on your insurace which will put it up slightly

I recently had a very similar thing happen to me. Lad went into the back of me and scuffed by bumper. We agreed to deal with it outside the insurance so I went and got him a quote straight away. Phoned him up and told him its going to be £165, when do you want me to collect the money. he decided he hasnt got enough money but will get it 'sorted' through his work but wants his dad to look at the damage first. They carried on messing me around so i phoned the insurance and set up a claim through his company.
At the end of the day the ball is in your court mate Dont be messed around by them. As pow suggest give them a deadline for the money. if you still dont get anywhere with it get a claim put in with his insurance. You will just have to declare a non fault, no loss of ncb claim when getting insurance in the future. Wont effect your premium though

i hate it when people do this
i remember when some moron hit me, slightly creased the boot floor.
i got a quote for him bearing in mind a lot of companies i went to wouldve written it off of £350
all i got was moaning, too expensive etc blah blah blah
in the end he payed up ages after he hit me.
does my head in, they do the damage but dont want to pay

Just be thankful it didn't happen on private land, some kid hit my mate on a shared driveway, cost him 400 quid to sort out which he said he would pay, my mate got the work done then the kid wouldn't pay and did a runner (it was someone living at a relatives) as it was private land there was nothing my mate could then do.
Lesson is, if you have a bump on private land, get them to admit liability in writting. asap.

Its only private land with no right of way that isnt covered by the Road Traffic Act (and thus you don't need insurance).

Im ringing to confirm this not at fault shizzle, no doubt each insurer will be different. Bloke didnt turn up yesterday, or I didnt see him. Theyve got my number and they havent contacted me, so Im just going to go ahead with the insurance route I think, been fucked about enough as it is

Just off phone to Norwich Union - made sure that a 'non-fault' claim wouldnt affect my insurance and she said it wouldnt. Obviously my excess has been waived (£320 ) and apparently ANY car after 5 years has to go for an estimate to see if it needs to be written off I bloody hope not, its only got a few scratches on the front bumper
Anyway once its booked in get a car off the garage (some little 3 door hatchback thing, gonna be strange going round in summat like that) till ours is ready 
First attempt at a claim and didnt go too badly, im mildly impressed, yet to see the outcome yet though

It will be. your NO CLAIMS will still be present, but you WILL have a 'no fault accident' logged, which will increase your premium slightly.
