Right got a strange question,
The girlfriend is still paying for the ex's car its on finance he is being an arse and wont start paying they split 6months ago. Her name isnt on the V5 though so in the eyes of the DVLA she isnt the owner, but as she is paying for it does this give her some leverage?

I've had this out with DVLA when somebody tried to register a crashed car of mine that the storage yard sold on without my permission.
The name on the V5 is purely the registered keeper, The person that drives the car and keeps it. That isn't always the owner.

So if she has proof of ownership like previous payments on the finance then she is legally the owner of the car. Well once the finance is paid off in full.

well its not actually finance it was just a bank loan so it looks like shes buggered and will have to finish paying it!

If it's a bank loan then the car is hers.
Has she paid for the loan since taking it out? Does the ex have proof of regular payments to her for the loan?
If not she should get a solicitor and claim the car then sell it on to pay the rest of the loan off.

Where was the car bought from? Dealer or trader?
Is there a receipt of purchase on the car?

yea was a loan from egg for 5k, 3years ago. He wasnt paying her back she was just paying for it and still is.

How was the car paid for? Cash, Bankers draft, bank transfer, Cheque?

You certain it's been cash?
There is the chance of proving she paid for the car by dates. Say she removed the £5k from her bank on 1st Feb and the car was registered on 2nd or 3rd of Feb.
Could be costly though.

go to a solicitor, usually some give you an hour free to see if they can advise you at all..

i recon if she has proof that she paid for car and that she is paying for it technically she owns it.

i may be wrong but id def be going to solicitors
