As far as I know it seems to be at the choice of the Officer who pulls you for it.
I've not heard of a definitive answer.
Most say it's illegal simply because it's not 'normal'. Some argue that if the tread itself doesn't protrude the arches then it's legal.
Bit hit and miss really.

is a grey area imo, the fact the garage made me sign a discalimer when i made them fit mine shows me there not legal but that doesnt mean unsafe

Strectched tyres are 100% fine as long as there within the reccomended TUV size guidlines for the rim width.
anything out of the reccomended sizes then its a grey area and down to the disgression of the tester. but you do get mega scene points.

As far as i know the tread surface needs to be under the arch, Also the tyres cant be damaged or bald,
I have brand new 215 Toyos on a 10J rim, The tread is inside the arch, the wheel deffo isnt,
My mate even took a 7J rim with a 165 tyre on it to the Vosa people on a motorway junction and they just scratched their heads

i thought the wheel had to bu under the arch to pass mot as its classed as a danger or someting,
is it perfectly safe to do this, i mean if you want a "spirited drive" and through it into a corner thers no chance of tyre coming off etc
