Got a letter from a debt collection company today saying I was overpaid in my previous job with the council.

I only worked there for 4 weeks before taking on another job but to my knowledge I got paid what I done, infact possibly leaving without getting paid a day or so's holidays I had accrewed. I left quick & made a months wages....didnt think any more about it. That was like 14 months ago...................now this.

They say I owe £107. But im pretty sure I bloody dont!

Should I just pay it? Is there much they can do except ask for it back?

I'm not sure they can ask for it back after that long.

I got a 6.5k letter saying the same last week

if its the council ring them and see whats the crack. 107quid error when you were only there 4 weeks seems weird to me

Could ask for timesheets/evidence of the days you were paid that you hadn't worked, I guess.

I was saleried, worked a month, got paid. I dont see how I owe them money

Not sure who to phone tbh the letter was from a collection agency working on their behalf

Give them a ring but TBH if it starts to becoma hassle I would just pay it,

I'm sure they have to contact you first as well before passing it on.

Who are the collection agency, some are just cowboys that send letters to scare you.

Debt is often passed on to Collection Agencies when they've 'sold' the debt, often for like 5% of what you owe.

So in the case of storecards etc where they don't see the money being paid back, they'll sell it on to another company for a faction of what you owe to make something back.

Suppose I was overpaid, which I dont think I was, not to my knowing anyway. Can they really ask for it back or get a debt collector onto me when its been over a year I last worked for them

Maybe try Citizens Advice Bureaux in the first instance, since it's free advice

Im fairly sure they cant legally make you pay it back.

They can make you pay it back if you have been overpaid, however you would have thought someone at the council's HR department would have contacted Colin first...

Thye have 6 years to claim BUT they really need to prove you knew you'd been overpaid to be able to get it back, if you had no idea then you have legitimately spent the money and they can't reclaim it, there are some twisted rules... its not very simple Im afraid

M&S over paid my mate a couple years ago.

They asked for it back but he ignored them.

He now has a CCJ against his name and made to pay it all back including an extra £200 debt collectors fees.

Get it sorted out asap mate.

Exactly, but the law is (and it is twisted like you say) very much on the side of the employee rather than the employer - especially when it comes down to such a small amount as £107.

I may of overpaid someone a few weeks back to the tune of £1200 so know a bit about it

Plus it's fucking out of order to just get the debt collectors without even sending a letter or making a phone call. I'd fight it all the way just for those reasons.

I owe 6k i've been overpaid cosmo, i said i'd give them back 500 a month because firstly i've spent it and secondly it's not a bad interest free loan at that rate, do you think they'll accept that instead of chasing me through court from what you know?

Like Robbo said, half the fight is proving you didnt realise you were overpaid. Thats easy to do with £107, its not so easy with £6k (unless it was over a long period?).
