do you have a wireless network? as it could of been some one connected to that?! how can they prove it was you? theres no law that says you have to use WEP or anything on wireless.

yeah we have a password protected wireless network going out to 5 computers.

they can't prove it was any one person of course, so i guess they would take the home owner to court (my dad)

To be honest, i would suggest that everyone uses PeerGuardian, certainly helps. And if you are using stuff like limewire and Ares, make sure you switch off sharing or making sure you moved stuff out of the shared folder - thats the usual way for ISPs to track what you have downloaded rather than the use of traffic and packet management.

Personal i would stick to Torrents or Rapidshare, both are a lot better than any that Kazaa/Ares/Limewire. Although for complete stealth, use SSL Newsgroups or just buy stuff

Saying that you didn't know who was on your wireless connection is no defence unless you can prove that this is the case, which you of course can't because it contradicts entirely your claim that you don't know what is going on.

Well you would know, as you'd just got a letter informing you of the illegal activity from your ISP and, ofcourse, it wasnt yourself downloading it so must of been someone using your wireless connection.

So surely it would fall on the ISP to prove it was you doing the actual downloading to take you to court? Or are they saying allowing someone to use your wireless connection (be it with zero security, or with a standard amount that someone MAY have got round) means you are at fault - in which case it opens up a whole can of worms which I doubt they'd try to push though court.

Im not pissed off people are trying to stop inllegal downloading, that has been going on for years.

im more annoyed isp's are taking it upon them selves to effectively police the internet, and as mentioned, i dont use p2p so i can still do all the downloading i want.

I also dont think scaring people who download a few singles of p2p networking is going to do that much to help the problem.

Its not the ISPs taking things upon themselves. They are under pressure from the music companies who are undoubtedly loosing a lot of income from illegal downloads.

The thing that annoys me the most, is not the fact they are tracking people and issuing court summons and fines...

It's the stupid amounts they're trying to fine people for the offences.

For example, you have been found downloading 'Colin McRae Dirt' ... (since most p2p networks work by active sharing, by downloading you would probably have uploaded a small proportion too)...

Therefore, please pay us £16,000 or go to court for loss of earnings from your uploads...

They just pluck figures out of the air for loss of earnings from people sharing.

Someone who shop lifts from a shop will get a slap on a wrist if first offense and a small £80 fine or so if caught after. Maybe after a string of being caught they'll face minor jail time and a larger fine. Yet if you download something - you face fines of stupid amounts? doesn't really make sense.

It's like shop lifting from a shop a movie... then them fining you for lending it to your mate for a week, or fining you because you 'could' of made a million copies and sold it.

I personally have always downloaded things I have no intention of buying. If I truely want something i'll buy it - however, it's the stuff I generally think 'hmm that film will probably be crap, that music album will probably be shite but i'd be interested to see if it is'...

i.e. things I'd never of bought in the first place. I have in the past downloaded a film that I thought I didn't like, it was crap quality but the film was a lot better than I thought and gone and bought the film as a result.

However, it's due to the fact that I only download shit I don't actually really want, that I'm not feeling frustrated or annoyed at the fact that I have stopped downloading any more.

However, it's also an interesting situation. I'd imagine only some ISP's are doing this and it's a prime opportunity for a new ISP to spring up 'offering anonymous use' as their unique selling point.

Either that or just new techniques to get around being tracked.
