As i posted before this chap bought a phone from me via ebay on the 17th june, this was sent to him via special delivery on the 19th of june - so should have reached him next day by 1pm (20th)
said chap has now raised a dispute on exactly the 45th day of been able to do so (1st aug)
i have no problem with this but hes done nothing but mess me about with payments etc from the start - iv not kept my proof of post as iv tidied up since june and havnt got the tracking number anymore
iv contacted royal mail customer services but have yet to get a reply - iv got 8 days to get this or im hundreds of pounts and a phone out of pocket
WTF can i do - apart from go down to middlesex and take back whats rightfully mine from this theiving bastard

I was in EXACTLY the same situation when i posted a PDA to someone. They claimed they didnt get it and opened a dispute. PayPal will ALWAYS side with the buyer unless you have the proof of postage. I lost out on £160.
Sorry to say it mate, but i think you'll loose out also. The buyer will get his money back.
Edit - You can prolong it by cancelling the Direct Debit PayPal have on your account....because they'll literally just take the money straight out without asking you. I did this, but they just then get debt collectors onto you

it was 2 months ago, why the fcuk would i keep something that i sent 2months ago that was gonna get there the next day

So he never contacted you once to say it hadn't arrived?. I'd have checked with him within a few days to make sure he had received it. Or checked the tracking of the serial number.

Unfortunately, this is the reason that I don't use Paypal for expensive things that i'm selling. 
He seems a right badger to do it on the 45th day though, hes obviously had the phone.
Is it worth reporting the phone lost to the phone company so that they can blacklist it? At least he can't use it then.

Well, the phone company that supplied it should have the details if you're prepared to chase it.
Edit to add. In future, make sure you keep all paperwork until you've had positive feedback and whatnot, as theres too many dickheads about these days.

I'd send him a message now saying 'oh well if it's been lost then you'll be getting it blocked which will make it useless'. At least he'll know if he does have it he won't be able to use it or sell it on. Not easily anyway.

If not just give him the scare tactic by saying you have the imei and your going to contact the provider to block it, might change his tune
