I have won this:

It turned up today and its a fake mp4 player that looks like its worth bugger all!

Whats my best route to get a refund. I've messaged them and told them to call me asap as its fake!

It clearly states "iPod" more than 5 times, I would say contact ebay about it, as the item is not as described.

False advertisment.. so techniqually you should be entitled to your money back?

You should be covered by eBay, just file a complaint (cant remember the name they call it) You should also be covered via PayPal if you used it.

That's shocking

I've seen the one's before that say something like

iiiiii pod for sale

or pod i for sale

or just write at the bottom 'this is not selling a geninune item etc'.

but i haven't seen one like that which clearly states ipod etc and yet the item is fake

These scams have ruined ebay imo, once upon a time you could find a bargain, but these days anything too cheap is probably a scam.

Yeah you usually get one saying 'ipod' type player. They are all twats and should be banned if they are falsely advertising.

1. You clearly advertised it as an 'ipod Nano 8gb, silver'. 'iPods are only manufactured by Apple and the name is copyrighted by them. You have stated its an 'ipod' 5 times.

2. On the actual item received there is no mention of it being called an ipod and its just a imitation and called a MP4 multimedia player.

3. The picture on the listing is of an actual genuine ipod. The one I received is not a genuine one and the buttons are clearly different. (clear way to tell is a genuine one has a play button at the bottom and the fake one I have received has 'volume written'

Its clearly false advertising and the item is not as decribed.

I would like my money back please, and I will send the MP4 player back 1st class recorded special delivery.

Pretty much to the point. If she refuses then simply open a dispute. If you get a refund, report her anyway

When you post it, make sure it's recorded delivery.

But tbh, if you paid by paypal, just file a complaint now anyway

yeh - i looked at the other items she had sold and thought 'hmm perhaps she got given it but the person who bought it for her, got it cheap at market or something and she didn't even realise it was fake'

but still she owes you a full refund... perservere mate - and if she kicks up a fuss go to ebay / paypal and get them to ban her.

Actually she did the right thing. As soon as you recieve payment for an item you must leave feedback to person who bought it, as that part of the deal is over. Then you'll get feedback on postage/quality/price etc.

Also, the fact that shes used a stock photo and not her own photo is a bit dodgy. Takes 5 mins to upload your own pic and only costs pennies.
