alright gents.

crashed yesterday, i wont go into details but im not admitting liability for it and im surprised the other driver was not arrested for speeding and/or driving without due care and attention.

now, insurance are saying in the early stages it sounds like it will be a dual liability claim.

but im only 3rd party (im paying £1,740 as well would you believe!)

i want the other driver to take the blame as he was blatently in the wrong but it all comes down to hard proof, so being realistic i think its guna be 50-50.

my insurer will not pay for me and they said i need to recoup recovery costs and insurance costs from the other guys insurance.

his insurance is direct line, can i expect them to pay out or expect a big fat fuck off, heres £20?

hey mate, i work in claims so should be able to help

sorry to hear bout the accident

i would advise getting an estimate for the repairs, and once the decision has been made on liability, tell direct line you have an estimate proving the repairs to your car will cost x amount, and you want them to re-imburse 50% of the cost once the vehicle has been repaired and get them to send you a letter confirming this.

if they start trying to negotiate with you, say your willing to get a solicitor involved and are willing to pursue loss of earning claim, etc because your car has been off the road, and they will probably just agree to the 50% as they cant be arsed with the hassle of a soliciotr getting involved, etc

thats how i would go about it if i was you mate

I will go and talk to my dad now, only problem is i think my cars a write-off, the other car looked ok as well which is sods law, my chassis has bent to the right due to the impact. i just dont get why he's not being prosecuted for speeding or driving without due care and attention!

speeding isnt an act of negligence unfortunately mate as its impossible to prove. driving without due care and attention is a cause for concern but you would a need a witness to back up your claim

good luck anyway mate, dont let them take charge, make it sound like you know what ya talking about

thanks again mate, i made sure i kept calm at the scene even thought the first thing the other driver did was square upto me shoutin the odds. Made sure i reffered to the police as 'officer', polite and corteous, i talked the same to the insurance lady at l+v as well.

If your certain its his fault then why not instruct your insurance to fight it??

i was told to find an independant wittness, but i cant, theres no cctv as well.

as mentioned above, he doesnt have any witnesses to the accident, so what grounds can they fight it on?
im afraid if all the info he has provided is right, it has got 50/50 written all over it

well, i got a call this mornin from the other driver who promptly made several threats 'to kick my fucking head in' if i dont call insurance and take responsibility.

i thought he was going to hit me after the crash and i've decided to just give in.

i called my insurance, told them i'd been threatened and that i was going to take responsibility, they accepted but they were dubious about letting me be bullyed into it.

i know the other driver has my address and personall details as i have his.

the police exchanged them between us, which is funny because i went to the police station the next day to ask for the incident number, i was told that when i was refused the officers names on the same night they should have told me and that their NOT supposed to divulge each others numbers and addresses, only insurance details.

i do law in college and we have a representative of the IPCC in tommorow- im going to let rip lads trust me.

only good thing is i have the option to pay for his repairs and keep my NCB

i know mate, i have the feeling he lives local though, although his address is in scotland which is other end of the country the fact his insurance called the next day makes me think hes a squaddie based in R.A.F st. athan, which aint too far from me.

i think hes the type of man who would come round as well.

Do not accept liabilaty whatever you do. fight it or your next insurance will be sky high.

Ignore him,or if he calls again give me his number im not to far from you id happily come have a chat with him.. i hate bullys.

i think whay he did was absolutly wrong as well boys.

it was a junction crash and he had right of way- of course i looked to check it was clear and when i started going, he came.

but i cant prove he was speeding so i think i might as well let it go, if he was absolutly at fault i wouldnt take it though.

but i know it will come to ''you were meant to give way''.

l+v said i can pay them back for the repairs if i want, i keep my ncb if i do.

You do law in college yet you accepted liability because he said he would kick your head in, doesn't sound right to me, especially if you have his address.

I'd be telling him to gtf.

problem though is, hes about 6ft 3, aggressive and probs a squaddy.

Im 24 6ft3 and 15 stone and if i remember right your in merthyr? so im in neath like ten minutes away,id happily come see him.

i know im tall aswell but dont let height put you off,my cousins about 5ft2 and he gets the better of me all the time the lil fuck

i remember when someone crashed into the side of me becuase they pulled out without looking.

they tried to shout and get into my face, i responded in the same way.
