on my way home today, goin down the dual carriage way (NOT speeding btw) in the right hand lane.

some old todger (89 to be exact!!) pulls out across BOTH lanes without looking once and this was the result:





not happy.

If you need, I have an imaculate wing (although its in green) and a standard light which I'm willing to sell if need be.

I'm guessing you wont need em though as your probably going through insurance?

JayM - if i was on a bike i would have been able to swerve out the way, alot easier said than done obviously though!

shouldn't have any pending claim tbh, other insurers should admit fault straight away. old people need to be re-tested, idiots.

well im hoping it'll come out with me in favour (at least thats what the police man seemed to think)

but even if it does, im only 18 and my insurance is gonna go through the roof

makes me glad i payed that bit extra for fully comp tho

You even took his tyre out - nice job.

Looking at the damage alone that is entirely your fault so make sure you have some watertight statements to the opposite effect.

to be honest it look like the micra has gone right over and hit the corner of the corsa so how would it be his fault?

i thought it looks like corsa in right lane, micra in left came over to the right

Because the Corsa had hit the back of the Micra and therefore was travelling faster than it towards the back of it.

Like I say, you need witnesses and lots of them, all saying the same thing - he pulled out.

Even then you'll need to fight the corner quite rigidly that there was no situation under which you could have taken evasive action in order to prevent a collision.

Did this guy admit anything at the scene btw?

exactly, so depends whether the micra has pulled straight out without indicating/looking or whether they have pulled out and corsa hasn't broke in time, but this would mean more front end corsa damage? i don't see any.

drifted? meaning the micra driver wasn't paying attention? that's just like saying i drifted across a two way road and hit an incoming vehicle.

if you drift into someones lane then that is not a safe manouver (sp)? mirrors-signal-manouver iirc?

i'm just trying to fight this guys corner tbh, doesn't look like enough front end damage to constitute it's the corsa owner's fault.

just make sure you make it clear what happened and don't beat around the bush, i hit the corner of a mondeo st rear and it ended up 50/50.

Im not fighting against silent_thunder89 or saying its his fault, im just pointing out what the Micra owner could turn round and say, that Silent-thunder89 drifted into his lane and hit the back end of the Micra, just to point out that he needs to think of that and to make sure it does get sorted in HIS favour... crossed wires i think back there!
