just been issued with a witness summons to go to magistartes court for a shoplifting case that i was witness to.
Thing is tho, ive told them about 4 times that i wount stand up in court, as ive already have my property vandalised etc due to it. but no apparently i dont have a choice, if i dont go i'll be arrested
seems stupid to me. any got any advice?

You've no choice i think, you have to go.....But explain to police you live in fear etc and property damage and see what they say..More than likely do feck all.

yeah i explained all this when i refued the first time....all they said was oh he'll prob get off then....i dont give two shits tbh.
but now ive had a summons which means if i dont go i will be held in contept of court.
might just no go, see what they do 
just wanted some experiences, of what to expect etc

I was a witness in court back in may, there is a law that if he does anything to intimiate u or as a result of the case after he can go to jail for a rather long time. they say if u see something u call the police n they have to respond asap

you will get in shit if you dont turn up. probably more shit than the shoplifter is gonna get.

Also when i went cos he knew witnesses were there he changed his plee so i didnt have to give evidence which is good cos apparently it was mine that proved his guilt!

yes i said that to the police that turned up...all they said was...try proving it was him

Goto B&Q and get a home cctv kit for £40 then u can prove it was him, if its really happening alot mate

There are lots of laws though. Not many people take much notice of them though.

ive been to court as a witness they kept me and my mates behind closed doors till the court apperance, but i am sure if you have a word with someone they can put you behind a screen off some sort etc.
thing is though when dinner time is up the witness and the difendant can bang into each other while out on ther dinner.
the diffendant was kicking off with the witness in court and had vandalised his car and told the police who was there and he got put on bail conditions to not come near any of the witnesses.
just stay focused answer ever question short and sweet and if they ask for a yes or no answe yes or no.... do not answer yes but cos they will start to ask you more questions.

Yeah if you don't go you'll be arressted and will be taken to court by the police, where you'll be handed over to the court custody officers.
Then, you will either:
Be taken to court to give your evidence in custody, and released after.
or
Go do the dock (not witness box) in custody, the judge will tell you off and say you have to give evidence, you will then get released and go to the witness box as a free man.

cant he just turn up at court though, go into witness box and just refuse to comment on the questions?

He can but the judge will just treat him as a hostile witness and they'll go by his original statement anyway, the judge will just give the jury the appropriate direction when summing the case up for a hostile witness.
If people don't want to give evidence they shouldn't give a statement in the first place, once you do that you're committed.

i made a statement, and was asked if i would go to court, and i said no, i didnt want to.
police guy just said oh, it prob wount come to that anyway, ive told them countless times i dont want to stand up in court. how much clearer can i be

Why give a statement if you didn't want to go to court?
That's the whole point, it's evidence.
