My girlfriend bought and collected a 04 reg corsa SXi from a dealer yesterday.

On her way home the emissions light came on so I told her to take it back and have them sort it, she dropped it off this morning and has just had a phone call...

We took your car out and an un-insured driver hit the side of it, told her she can have the money back she has paid for the car but not the car she part exchanged for over £1000.

That doesn't sound right to me, them keeping her old car.

So she is now carless and over £1k out of pocket.

Is there anything she can do, I don't know the full story yet as she just rang me (at work) as she is rather gutted, upset, pissed off etc etc.

What would you guys do, any advice greatly appreciated.

go down speak to the manager, ask wehy she cant have her PX car back, and them threaten to seek legal advise and inform trading standards. the manager will shit his pants and give her the car back!

They have probably promised it to someone who works at the dealers or something (part ex car), tell them you want it back or if not you want the trade in value.

They are trying to fuck you about, tell them you will be involving trading standards.

I've thought this straight away, car was left in the dealers responibility when dropped off.

The dealers insurance should be making a claim for this car through some un-insured driver backup money I heard something about ages ago.

But if thats the way the dealer is treating her, then I would say, car and all of the money back she paid.

If not they need to cover the cost of her trade in car also (bare minimum) IMO

she gave a car and £3k for a car, which they took out and wrecked and will only give £3k back?
if thats right shes entitled to the £3k and car or £4k back. its blatantly obvious, so get in there with her and dont leave until you get what your entitled to.
or go trading standards, they had no need to be out on the road in her car without her permission

Yeh she paid £4150k and traded in a saxo for £1100

I'm going through when I finish work to kick up a fuss, they making me mad and I aint got there yet!!!

Cheers for all advice guys, just needed to know I wasn't the only one thinking what they are trying to do is all wrong.

They said about fixing the corsa but I told her to refuse it as it would never be the same again.

Haven't seen the car damaged yet but... told the side is caved in!

Fuck about! Surely the dealer has insurances in place for this kind of thing.
End of the day the crash is nothing to do with your missus - they gave her £1000 off the new Corsa for her old car, so if they say they will just take the damaged Corsa back then fine - but they owe her £1000 for her old car.
I would be going fucking nuts at the manager if it was me - ring them up and ask to speak to the owner, try and be as calm as possible, explain it to him, if he gets you the fob off then ask for the name of who you have just been speaking to and what their postition is within the company and bid him a fond farewell - then get straight onto the phone to trading standards and whoever else you can to fuck him over - Robbing twat!

Is this Dobies? They are seriously crap. More so than other Vauxhall dealers.

No way will they be able to get away with her being 1k out of pocket or without a car...

Her dads been down and talked some sense into the bastards.

Getting her old car back and the full amount for the SXi, least they seen sense in the end, and realised they can't do what they were thinking.

Shows what difference some male influence has on car garages.

Sounds like shes been taken for a mug. I bet someone hasnt gone into the side of it and they are just trying to have her off. You need to get details proof and that see what the terms and conditions are of the purchase aswell cos that dont sound right at all.
