got a brand new o2 mini s from o2 last month, sold it on ebay as I am due an upgrade (was an insurance replacment)

sold for £175 which I thought was a lot

I know 101% it works fine as I used it for a while before I sold it, did a hard reset the day before i posted it

some guy in London paid over pay pal instantly, sent it same day, now he is saying that the phone is faulty and does not work

1. how do i stop him taking the money back from my account?
2. I took the EMEI number down before I sold it as he only had 1 feedback...I will tell this if he is thinking about sending me a faulty phone back in return
3. any other advice?

(1) get photos or video of phone not working...

(2) request phone back - if u have alot of feedback, if it is faulth the send refund.

i used it everyday for a month. its only a month old. I do not have any proof for him though, you do not really expect to have this hassel

Always expect a certain degree of hastle on e-Bay. It helps to include in your advert - "No refunds or exhanges". Can put some e-Bayers off though, but does protect yourself from would-be-scammers etc...

not worth anything in the eye of the law. if it WAS faulty then he would be eligable for a refund. BUT if it WAS faulty i would not have sold it

I have the o2 paperwork here with the EMI number on it and date, if he wants to send me it back I will check this, if it does not match he can get to fuck

hope he dont think its just an easy way to get a broken phone fixed, twat

get him to take it to a o2 shop, get them to check it over and fax/email the findings though to your local o2 branch

Ok first off he is saying that it does not get past the blue screen, now he says it will not boot at all (I smell bull shit)

this was my reply

"Please be aware that I made a note of the EMEI off the phone before It was sent out and marked it inside so I know that a different one is being returned. I am not saying this may be the case but I once lost out on £300 when someone with 0 feedback returned a camcorder to me and it turned out to not be the same one I sold so I ALWAYS do this with everything I now sell on eBay. If you would like to return the goods then please be aware that I will not be refunding any money until I know that the handset is the same one. I will have o2 look at the handset to confirm this is the same phone they sold me a few weeks ago too. Or, seeing as the handset is only a few weeks old, you can take it to the nearest o2 store yourself and have them look at it under warranty and have them fax or email me their findings. This will be free of charge as it is new. I await your response."

why wont O2 accept it back? they are only going to look at it to find the problem (if there is one) and if its got a warranty??? he is trying to pull a fast one imo
