Dads is meant to get a new company car every 3 years on 1st March. He's due his new car this week. His boss has had a word with him today and told him that because one of the employees is leaving, dad will be getting the other employee's old car which is a year and a half old along with a payment of £1000.
It's in dads contract that he'll get a brand new car every 3 years. Mum is going mental telling dad not to accept the offer and that the company have broken their contract. Where does he stand, anyone know?

Any contract is legally binding so he is well within his right to say no i would have thought

Probably in a year and a half's time. They only keep them for 3 years from new.

i think they are of posh don't accept cars that have had someone else in the drivers seat for fear of stains/smells etc joking

Probably the fact your entitled to a new one & still have to pay the tax on it when your not getting what your entitled to!!

I get about 4 or 5 different NEW cars a year tbh, so I cant criticise them! (yes, i am showing off, and do enjoy pissing off the neighbours with new cars all the time )

You only pay tax on the value of the car though Colin, so as the value of the car is less at the time its given to him, should mean he pays less tax

Then again £1000 is not bad, still get a free car. Tell him the boss needs to up the offer of £1k to £2k (& tax free) or else he wants a new car like he's due!!

Yes but im just saying a company car is not free like some folk seem to think, & I think if you have to pay for it you should get what your due!!

Company car tax is calculated as a percentage of the P11D value of the car, worked out based on the emmisions etc. of the vehicle, that is seen as a 'Benefit in Kind'. Then you pay the normal tax amount on that 'BIK' or 20% or 44%(cant remember the exact numbers, mental block).
Works out about £40 a month for me on an 'Ibiza'

Yeah but thats determined when the car is made & doesnt matter if its brand new or 18months old!!
Would you be happy to pay £40/month for a car that your not the 1st owner???
I know how company cars work, im just saying he should get a new car, not palmed off an old one to save his boss a few £k's.

tbh, i dont know hos it works on 18month old cars, that's something i'd need to be educated on, as we only ever deal with new company cars then leave it to our accounts/payroll dept. to fuck up

Well I for one wouldnt be happy paying out for company car tax for a car that wasnt mine from day 1!! I would rather opt out & buy my own car if thats how its to be!!
