Ok, I went the doctors yesterday, and basically he has signed me off with a note due to a chest infection, but as I have past history with pneumonia and plurosy, he said to take no chances...
boss just rang & said sicknote or not if you dont come in your fired...
Now
he can't do that can he?? AFAIK the sicknote is as good as gold paper, so if he does fire me its unfair dismissal = industrial tribunal against him = payout?
Just waiting for the doctor to call me back inregards to this also, and Im gona pass on the boss's number & details to him too if requested...

AFAIK they can take action regardless of if you have a doctors note or not (the company I work for have a similar policy), if you're a member of a union then I'd be having words with them, if not then maybe speak to the C.A.B (Citizen Advice Bureau) and see what they say.

he cannot fire you. how long you been there?? if over a year, and he fires you, straight to ACAS - unfair dismissal.
sicknote is rock solid evidence you are not medically fit to work, that is the point of it. i am sick and have been for 3 weeks. my work are sound and dont even call, just keep sending the notes in. your work should not call you at home - this could be deemed harassment.

tbf the only reason im there is for the money otherwise i cant pay the rent
i am lookin now, but finding another job when a student isnt always easy

Sounds like he knows he has you over a barrell (so to speak) - i.e he knows how much you need the job to pay the rent and how hard jobs are to come by so thinks he can make you jump through hoops for him.

i was off sick last year after car crash and got p45 through post c.a.b said nothin i could do. funny thing was day the payed me to was day ment to start back back with them now though

well rang tha c.a.b and said they are referring me to employment law merseyside?? as i have a sick note from the doctor, then he must honour it and with him threatening to sack me like that (as mentioned) is deemed as harrassment
there ringin back in about 10 mins

my wife went sick, was signed off by doctor, sent note in then got letter a week later dismissing her for gross misconduct. if they want you out, they will make a reason justifiable for them to sack you. sit tight, get the job hunters guide out and start looking. expect the worst, be prepared.

you can take discaplinary action against an employee for being sick it will be bassed on the employe being 'incapable' However you must first go through the proper pocess this would normaly be counseling, verbal warning, written warning.

well CAB said as ive not been there for 12 months yet there isnt much really i can do...

but if it makes me worse im gona fook him over a lamppost... still have the sicknote & they said if it does worsen your condition and the doctor agrees then there is still basis for something...

your verbal warning should only have been the outcome of discaplinary hearing.... you would need to have been off sick at least 5 times within a year in most compawnys to end up getting sacked, seen as he has threatened you with the sack it is obvious he has no idea of employment law.
