I study law but am a bit confused with this situ!

I got removed from time and envy posrtmsouth last night for giving someone else my ID, yet its physicaly impossible..and i can prove that all ID that is me i had on my person all night (cctv, speeding fine so no drivers licence etc) now i got asked to leave, yet they could not prove someone else used my ID and would not state what ID they had used!!

are the legally obliged to chuck me out with no proof? im pretty sure that without sufficient proof then they have no rights? or am i wrong?

when speaking to management last night he said he trusts his security and that if they believed me to have done such a thing they are entitled to ask me to leave..yet they could not ACTUALLY prove that they were in the right! do i have a case?

Not sure if it's related but I do know they have a right to refuse entry without giving a reason so maybe it works in the opposite way/they don't need evidence? I know my brother did some work at the open protecting millions worth of jewls/watches etc and he said they had the right to ask somebody to turn their pockets out without evidence - only if they even suspected they had nicked something.

cant help you mate but IMO 99% of bouncers are wankers on power trips.

when i was in town wednesday night i was informed of "challenge 25" and asked for id. now im almost 25 and look at least my age so havent carried anything since i was about 18.
then they give us the shpeal of "i tell you waht guys im gonna let you in tonight but drop the attitude". i was like "what attitude" and they started bitching.
fucking tossers

and to top it all off we were speaking to some girls in there who we know and they are only 17

apparently in cardiff now its challenge 25

which i think is fucking stupid cos its not as easy to judge between 21-25 as it is between 18-21

hmm i know they can refuse right to entry and search etc..but to remove someone with no proof...after they have paid..surely thats not legal...especially as i proved to them my innocence!

it may be illegal but not much you can do about it as if you did they will turn around and say they threw you out as you were drunk or something, they will coe up with a legal reason

i have 6 witnesses tho....they serisouly chucked me out on the street and refused me re entry after i have proven that i was innocent...under the HRA act 1998 they have acted unlawfully and i can prove this...

i dont know what i want out of it...just really to prove a point i suppose...i can prove they acted unlawfully..as they had no rights to remove me with no proof etc...if they had chucked me out for being drunk i couldnt argue...but by sayin i gave someone id when its actually impossible!

maybe im going ott! lol but i like to prove a point! they are gonna get a nice letter today...

you might start by making a statement to the police for assault esp that you have witnesses (if they will go all the way), then bring a civil case...

and the ticket you bought is a permission from them to enter their property/premises for the duration the ticket is valid. It's a contract and unless terms of the contract have been breached, they cannot force you out of the premises

You have no case, they are completely in their rights to do this so long as they are licensed under the Private Security Industry Act 2001.

have skim read the thread, but in response to the original question you have already done all you can, which is complain to the management.

Not really much more you can do fella, a doormans word is final and any decent management will back up and trust his staff.

You dont really have a case for anything, ie what resolution would you expect?

If you go back and make a fuss you could risk being banned, just one of those things its happened to everyone at some point.

they can eject anyone they like, just because they want to, it's up to them, working with the propriator of course!

Although, using force to do so opens up a whole new kettle of fish. they can still ask you to leave, if you refuse then they can use reasonable force.
Tbh, you don't have a leg to stand on in regards to being ejected, if they don't want you there, they don't have to let you in. if they assaulted you, then this is different.

Although yes, a lot of them are to55ers on a power trip!

Bouncers only act like that because of management, most of them couldnt give a toss what goes on. I dont think there on power trips there just doing the job they have been asked to do.
