i had a crash last Ocotober, which i thort was being dealt with by mine and the third party insurance (i was only third party)
i recieved a letter this morning from a solicter telling me theat they have been called in b ecause my insurance isn't replying to any letters etc. and they are taking me personally to a court to recover losses
Anyone heard of this before?
surely i'm not going to have to pay out, thats what the insurance are for!!

Just phone up your insurance and send them a copy of the letter. You won't have to pay anything unless your insurance company will not indemnify you ie if you've undeclared claims/convictions/mods etc

it was planet, got them though quoteline direct! the car was a completly standard Saxo VTS.
just really worried that i'm going to have to fork out, i have also sold the car now as i was only TPTF. have only just seen the letter so will call them tomorrow

everything has been reported to my insurers, filled out all the paperwork etc. even had to attend a driver improvement scheme which was a joke cus i didn't even think it was my fault, any legal bod on here able to give some advice?

call your insurance tomorrow, then send them a copy of the sollicitor's letter by recorded delivery and keep the proof of postage.
Then phone up the sollicitor tomorrow and tell them that you have contacted your insurance again

Yes, basically what I said. The reason that the sols would have wrote to you is that the other party's insurers would have repaired their Insured's car and looked to Planet to reimburse their outlay. Planet are either disputing liability with them or have a large backlog and are taking a while to respond. The letter to you would be a scare tactic to attempt to give your insurers a kick up the behind lol.

can they prove that they sent several letters to your insurance?
Is it possible for them to repair their insured car and try and get a reimbursement of their costs?
