I had my lupo bumped into at some traffic lights before my first holiday it was around about the 5th july a few days before i went away (not much damage to the outside, but my boot floor was crushed and the shassy was slightly bent!), rang my insurance company they arranged to pick it up and take it for repair whilst leaving me a 06 corsa sxi (which im not complaining about!) its now about 3 week after the crash iv been on holiday again hoping that when i got bk my car would be here and it isn't which im annoyed about! I rang uk assistance where my car has gone and they said my cars fixed but they need paying my £500 excess which i wouldn't mind if it was my fault but it isn't and iv had letters saying they have admitted full liability so her insurance should pay it which is what i got told before my car went in, iv now refused to pay it so uk assistance are refusing to give me my car bk untill i do! What id like to no should i be paying the excess or not all i want it my car bk!!! Please help!!!

I dont think you should be paying the excess if it wasn't you at fault.
Is there nothing about it written in your insurance policy?

I believe in these circumstances you pay the exces then get it refunded when the other parties insurance company pay out

you could pay it and send the reciept to her or her insurance and they should give you your money back. When i crashed my car i was getting charged for storage, so i payed for it and sent the reciept to my insurance and they refunded me.

correct, when some prat drove down the side of me in a van and knocked my wing mirror off and scratched all paint work, i had to pay the excess then claim it back thru his insurance company.
i had to pay £450 and got it all back.
