Is this actually permitted?

I have jsut bought some lights of ebay, paid the guy and he is refusing to send until i have paid his paypal fees?

This is what he put on his ad:

paypal is my preferred payment option however a 5% surcharge must be added to final amount (thats how much paypal charge me)

Can he do this?

If it was stated in the auction, it means you agreed to the conditions before bidding...only IF it is there.

He cannot ask for it AFTER listing ends...only ON listing page or DURING by adding info to auction.
