Driving up the M27 a few Sunday's back, And pull off at my Junction. When I did so I pulled in the lane in front of a Honda CRV. (The hideous 4x4 thing). Person got angry, and started flashing it's lights. Thought ah well, these things happened, waved sorry in the mirror and carried on as usual.

A few days later, A letter arrives from the Police, has my name and address on it, and my Reg Number. Says i've been accused of "Driving without Due Care and Attention, and failing to stop at the scene an an accident."

Ok... Cool.

Phone up the police department and ask to speak to the copper, he tells me that the car has complained that i collided with it when leaving the motorway, and failed to stop. Guy advises me to fill out the forms. Went to speak to someone I know and showed them the car. Filled out the Forms. I haven't sent them back yet. (I have 28 Days to do so). Forms are still sat here in front of me, I'll send them today.

My parents came back from holiday yesterday and checked the answer phone. Tell me there's 3 seperate messages from Asda Insurance. Great. So I phone up and ask them what's going on. Apparently the 3rd party is trying to claim off my insurance. By now I have rage , But I carry on the phone call and get all the details to hand on to any solicitors or other insurance companies that may phone me. I tell my insurance company the same story, that I left the motorway, but there was no collision etc.

Really angry at the moment. I wonder if anybody has had them try to claim off them before, and there hasn't been an accident?!

WTF!! Are you sure you didnt touch that at all, maybe something flicked up and hit them and they thought it was you or something. Dont pay out though mate if youve done nothing wrong. Stand your ground.

i had this... made the police come out to my house and check my car over. they left satisfied that there'd been no collision and had a nice cuppa too. lady officer was fit as fook too, thats another story though

take it you received a NINP... notice of intended prosecution?

Sounds like a bit of a fankle!!! I dont know what to do tbh...think id go see a solicitor because someone is trying to get you into alot of trouble. Was there anyone else in the car with you at the time???

Matt, don't know what they're claiming for. Front or side I premume. Although I was close, I am absoloutley adoment there was no collision. Don't know if anything flicked up, but the bird from Asda said that they complained of a collision, not debris damage etc.

The car was a Honda CRV, If i'd wacked that in my fragile Vauxhall Corsa, I probably would have ended up in the Armco.

Not a NIP yet Riley, Was just some forms wanting me to be named etc and comfirming what happened.

If the police get involved it is essential to have them examine the car tell all insurance people exactly what happened... no collision

ooh and anyone in the car cannot be used as a witness

I cant see how they can claim against you once the police/insurance company both see there is no damage to your car

I know that. A policeman has seen the car, and can confirm there is no damage.

Was it some old coffin dodger in the CRV

Just fill in the forms for the police (shows you have nothing to hide) but dodge Asda insurance for now....as far as your concerned theres no place for a claim so dont get either them or your own insurance involved!!

U had 2 mates in the car with you???

Phil...

1. Was there anyone else in the car with you as a witness or were any friends following you and could serve as witnesses?

2. Have you taken dated photos of you car showing that there is no damage? Or can you invite a police officer around to prove there is no damage to your car?

3. Can you get in touch with the person who is accusing you to find out what it is your supposedly did? Or do you remember there reg plate?

As far as i can see if you didn't hit them then it's not your fault... i love this sort of shit i'll research it and find some info on the laws and so on surrounding this

Phil, have you got in touch with the insurance and instructed them that the police have been to your house and confirmed there is no damage on your car whatsoever?

Sam,

1. 2 Other people in the Car. That makes Me, Nick and Sam. (Names are Easier).

2. No Dated photos. I washed and chamoised the car a couple of days after. No damage there. But obviously no proof either. I showed a policeman it as soon as I got the letter, I took it to him, asked advice on filling the form and asked him to check the car over.

3. No I can't get in touch with them. Insurance companies are now doing all the correspondances. etc. Don't remember a number plate, as obviously I didn't expect to see the car again, or hear about it.

I know it isn't my fault. I'm worried about my NCB now. Obviously if it has to be used up i'd have prefered to actually have had an accident.

I've told the insurance that a policeman has looked over my car for signs of obvious damage, traded paint. I've got details to give to a 3rd party if they try to phone me etc.

Haven't considered Legal advice yet. At the moment I've simply told the police and my insuracne company that there was NO collision.

Cheers for your help so far everyone. Was half expecting the bandwagon slating for being in the wrong place at the wrong time .

It's quite clear somethings up here I can't see how if you did hit him you came away unscathed there would have at least been some sign of damage you'd notice especially considering how immaculate the car is anyway - it'd stand out like a sore thumb.

I can only assume that this person imagined it or thought it happened due to some stones hitting there car Or simply they want to try and prove a point to you for your driving (i'm not at liberty to comment on it as i didnt see it .etc but some people are a little touchy and take things to far) or they're council and looking for a cheap buck/to repair some existing damage

Maybe you could ask your insurance company to find out of his/hers what the damage is thats happened and also any proof of this damage e.g. photo's .etc Now the worst case scenario is the car has already had a bump and wants it fixed so is claiming to get it done... but hopefully your mates will provide a suitable aliby here as being in the back (or at least one of them) they would have certainly noticed or felt a collision.

Your insurance company should be backing you up here saying that the police have been around to inspect the vehicle and there is no damage whatsoever (try and get it in writing). So as far as they're concerned no basis for a claim!

Seriously though if hes saying there was a collision with you at the front then it would be his fault for not stopping in time and if he's saying your car swiped his at the side there would be noticable damage to yours....which there isnt!! Where does he stand

No collision / no damage / no claim / stick to your guns and tell your insurance company NOT to pay out..

you were in front of them so by the ways of the highway code he has to avoid you, but does not get round the un-due care and attention bit....
