Bought a tv tuner device from www.dabs.co.uk

After receiving the device, i was not impressed by the picture quality, and after exhaustive solutions from haupaugge this has not been cured.

I requested a return and refund from dabs as not happy with the device, and was a little astonished to recieve this email back

"Hi,

Unfortunately, because the part has been opened and installed/used we're unable to sell it again (without incurring losses). Selling on used goods as 'new' does not comply with the Distance Selling Regulation.

Therefore please be advised that we cannot accept the part back for a full, or partial, refund or exchange.

I found this a little odd as i thought i made it clear that it wasnt fit for the purpose,

I replied saying that if they do not give me a refund i will seek legal advice, anyone know exactly where i stand legally?

btw there have been amendments to these regulations concerning consumer protection...will need to have a look at it

write a letter of complaint and send it recorded delivery expressing your dissapointment of the services and that your rights as a consumer is being affected

I would

make a call and as always express your dissapointment of being a customer of dabs...how it would have been better dealing with PCworld, Currys etc...that your rights are being affected

and also tell them about the said Regulations...

yeah, i always used the tactics of praising other shops and it always worked...without any problems...

actually, i had the same problem 2 weeks ago, bought a camera onlien with PC world, got it, wasn't happy with it (and got a better camera and deal elsewhere: comet online), phoned PC world and they just advised me to go to any of their shops and they issued a full refund

well, i did have with a salesman at the shop who didnt want to take it back because according to him, the camera was not faulty and that it was opened. As usual, I asked to speak to the manager, and he accepted without any problem at all...it's the salesmen who make problems and life difficult

Steve Williams: Good morning, last week i purchased a Haupaugge (sp) TV tuner device, however after plugging it in the quality coming thru my TV was very bad, I had had tests done and its not the signal, and had many solutions tried by Haupaugge direct but none has improved it, so was looking at returning the device for a refund

Steve Williams: i emailed assistance@ but they replied stateing i was not entitled to a refund

Steve Williams: obviously I am not happy with this, my colleague took a tv card back to PC WOrld as he had similar problems and they refunded straight away

Lisa : Do you have your sales order number for this item?

Steve Williams: yes bare with me 2 seconds

Steve Williams: thanks a lot

Lisa : You can request a return online under faulty goods and this will then be brought back to be tested for fault.

Steve Williams: ok, i dont believe there is a fault as such, jsut the device doesnt perform as expected

Steve Williams: or as stated on the box "High Quality TV Output"

Lisa : If a fault is not found the product would be returned to yourself.

Steve Williams: Quite simply the device is not fit for purpose or as described, i am entitled to a refund under sales of goods, if you do want to pursue the matter I am quite willing to seek legal advice

Steve Williams: like i said other stores seem to have no problem adopting this policy

Steve Williams: if you are quite happy to lose custom over this, and face the possiblity of legally having to refund the money it does seem a little pointless does it not?

Lisa : We will have to test this item on return for fault.

Steve Williams: if you ordered an item of clothing online. got the correct item but it was a slightly different colour than you were expecting would you not seek a refund?
