heres the scenario. maybe u can help me.

ive bought another car. my mate wanted 2 c it. i let him drive coz he sed he was insured on any vehicle, he geniunely thought he was, so did i.

hes drivin and we get pulld by traffic cops.

hes not insured to drive any vehicle so their system says, so hes committed a drivin whilst not insured offence.

i gave him consent to drive my car, without chekin certificate, so im committin the same offence.

i explained hes been a mate since we wer toddlers, so to ask wud b rude of me. if he thinks he was when hes not, hes just made a geniune mistake. im insuired on it, were both insured on vehicles.

they sed we can both get upto 8 points on our licences. summons will be in post, court order.

however, we were given no paperwork, producer, or anything.

whats ur verdict? Is it a slap on the wrist?

Its not the same offence. Driving without insurance is offence code IN10, which carries between 6 and 8 points.

Causing or permitting an offence like that means that you would get IN14, which is otherwise identical but not the same code on the paperwork.

The fact you've got nothing there indicates to me that the copper either didn't know the code and was going home to find out.

One of three things will happen.

He'll find out the right codes and do you both.

He'll find out the right codes for next time but forget about this one.

He'll not find out about the right codes, try and do you for an IN10 which will be an unsafe convinction which I recommend you dispute.

Only way to know for definate is to wait unfortunately. Strange that you were not given a producer though. Without that there is currently no record of the stop, its location or particulars of the vehicle or its occupants.

Did he let you drive off having checked that you yourself were insured?

He'll need a great memory to convict for that with no paper record at the scene. Not out of the question, but the fact he's let you go with no producer says he's not planning to go anywhere with in.

Not sure tbh. Shame but there's not much you can do apart from hang on and see.

Why did you both think he was insured on any car?

he has a fully comp policy, and thought he was automatically entitled to drive any car.

i thought he was, coz he maybe has seen it written on his certificate, and thought not to ask coz ive known him for so long.

he might've checked, but have you checked his insurance docs, copper could have it wrong, your mate couldve read it on the insurance somewhere, could be deemed to be misleading perhaps? worth investigating

Not really, there's certainly an offence in there somewhere. The station won't be able to confirm whether or not you're actually getting done for it.

I got pulled over and 'busted' a few years back in the supra.

I was given a producer, and was told i was being prosecuted for dangerous driving, racing on public highways etc. ( i accelerated loudly upto 30 !!!! he said i was racing the car in the inside lane.... a 1.25 fiesta.... hell yeah)

The only witnesses were 2 police officers, myself, and 2 of my mates.

Nothing evercame of it after i produced my docs

Surely if they were going to book you, they'd give you something to produce, AND the actual offence slip. Otherwise how are they going to know who you are?

they did checks over the radio of our names addresses cars and dates of birth etc.

if they have a camera in the car, do they not need 2 giv u a producer? coz of video evidence?

I thought notices of intended prosecution had to be issued within 2 weeks of the actual event occuring....or is that only with speed cameras?
