I know usually its an instant ban over 100mph. He knows what a tool he is. he has had at least 9 points since he got his license 12 years ago.

He has just had his court summons and is taking (on the advice of his lawyer) one of the company directors who will plead for my mates licence as a matter of his job. The lawyer thinks that he has a good chance that he will escape a ban and suffer with a hefty fine but im not so sure.

What do you think?

I'll keep you posted coz his court appearance will be early Jan.

Ben.

He may get a ban for a short time 28 days for example and a bigger fine instead of points.

I think the fact his record isnt too great with his driving licence so far may have a detrimental effect to his appearance, but, we shall see.

He'll get a short ban as chris suggested.. 28 days or so..

He might aswell have fought it if he's on 9 points anyway, he has no chance of getting away with it if he pleads guilty.

Well, he doesnt have 9 points anymore, but even though the points arent on his license (maybe 3 points) , doesnt mean he wont get questioned on them.

He won't get questioned on them.

They will not be revealed until he has been sentenced.

If they are brought up before that, he could file an abuse of process complaint and case dismissed..

He will get banned. Put it this way,

He has 9 points, that wont look good to the magestrates, it will look as though he doesn't care.

If for whatever reason they choose not to ban him they will be obliged to give him a fine and points. This is commonly 6 points for going that fast, even if he's lucky and some how manages to get only 3 points his licence will still have 12 points and he will get banned for that...

I dont quiet see the logic your making here? He was in a company Mondeo at the time but he owns a tasty Scooby. Why do you have to be under 30 to speed?
