basically guys, going round a dual lane round about, in inside lane indicating right some bloke appears from nowhere says "i Slammed my brakes on but i couldnt miss you" very greasy roads contact speed was about 20mph fair enough i was in the wrong lane to turn right but does anyone know of any leway where i can prove he was driving to fast for the conditions or something like that. included diagram of where we ended up i was travelling at about 10-15mph mines the red box. any help would be great its a borderline write off waiting for the estimate.

Do you have any witness's? if you have a witness that says you indicated clearly before the exit, you might get away with it..other wise, its your word against his mate

no havent got any witnesses, local garage reckon get a mate to be a witness without insurance knowing were mates reckon thats dodgy as fuck though.

that does sound a bit dodgy. I'd say it was his fault anyway coz he shud've been lookin were he was goin especially if the conditions were bad!

yeh thats what i thought but they try to base it on the highway code which means i was in the wrong lane and apparently cut him up the fact that he was probably going way to fast got a bit of understeer slid and destroyed my car prob doesnt matter we all know what insurance companys are like B***ards just need to try prove its his fault now great!!

depends if the turning right has two lanes coming off it... if theres only one then you would have been in the wrong lane and cutting him up, if not then assuming you were heading for the inside lane then you would be in the right...

say u were in the inside lane indicateing 2 go right then wen u past the 1st turn of u moved over in2 the left lane ready 2 come of at next turn off an he came up from no where an must have misjudged the bend an breaked while turning thus makeing him slide in2 u if hes hit u in the side it will make it his fauilt

Just remember to mention that u had your lights on and you were indicating u checked your mirrors an saw no other vehicle then as u emerged towards the next exit the other vehicle hit u u dont know where it came from as u checked ur mirror as you started to signal earlier in your manouvor mention that you were traveling at low speed due to weather conditions

I would say that his vehicle has hit yours you were the vehicle that was infront

you were the driver that was driving at a sensible speed an was indicating to so other drivers where aware of your manouvor if he has come from behind and collided with your vehicle then that states that he has been driving without due care an attention and has caused a road traffic accident if you get the police involved he could get done for that and that surely puts the blame on him

if your unsure i would seek some citizens advice or speak to a community officer

cheers guys ive sent all the stuff off to the insurance there fighting it out at the moment i mentioned what youve all said and i think their saying that because he was behind and it was a dual lane exit he is in the wrong just got to let them fight it out

So many people have sat in the inside lane, I'm overtaking on outside lane and going straight on... they pull across me on the roundabout to get right

Ive got the same problem as you mate i had a smash in lanes but i was stopped. I had a witness with me but because she said i was nearly stopped and i said i was stopped there sayin its contridicting evidence. He wont admit it and goin for 50/50 but im going to court of it and got rid of the witness. Just go all the way is what i would suggest. take photos of the scene and that.

Old thread.

I would be curious to see the outcome of this one. Depends where each car entered and left but the Rover has crossed the lane of the Corsa which is staying on. Highway code clearly states that when leaving a roundabout from the outside lane you need to check for the presence of vehicles whose path you will be crossing. Section 163.

ie. Rover failed to see and take evasive action to avoid Corsa. Corsa is actually entitled to be there, unless you've stayed on too long.

Driving in accordance with the Highway Code - cheek of it.

You cross the path to leave - you check if there's a car there.
