Right, cut long story short.

My old car sold 6 months back to some1 i know. it was written off Cat C (Category C - Repairable. Possibly structural damage. Cost of damage (at dealer prices and labour rates) is more than book value of vehicle)

We decided to get car fully repaired. etc this was about 1-2 yrs back. i had car for a year and bit passed all mots etc and has been fine, then sold to this person i know. they have had it 6 months.... it looks like they have been trying to sell the car and havent. so there now trying to say i didnt say about the write off (which tbh i "dont think" i did as i had forgoten by that time and had the car myself a year and bit...

They are now asking for all there money back or taking action. Going to see where i stand legally tomorrow but thought id ask on here also.

Its their responsibility to see this for themselves as this would be on the reg document, it is on mine.

yeah they should of had it HPI'd regardless if they know you or not

You have to disclose if asked and there's a legal requirement not to misdescribe the car when advertising, but there is also a big onus on the buyer to do some checks.

Would it be practical to buy the car back at his selling price rather than yours 6 months ago?

has the bloke had ne porbs wit it? if it woz repaired propperly then does it matter if it woz once writen off? my gsi woz hit n should of bee a write off but its goin bak on the road. if i sell n some1 asks if its been involved in an accident then ill tell em but if its all ok after bein fixed, is there ne need 2 tell em unless they ask?

Incorrect James - if its been categorised by the insurance company then it has history which you must declare when asked.

You can't just assuming because the car is OK that its clear.

Reason there more less sellin is due to having a baby "just arrived". i dont have the money atm to buy it back. if i did i would.

I didnt mis discribe, neither did they ask if it had been written off. I agree they should have HPI checked the car and thats there fault there.

They havent had no problems with the car since they have had it that i know of.

They are just looking for a workaround cos they are having difficulty selling it, probably at the price they bought it.

Wrong.

When i sold my calibra turbo the buyer rang me up to tell me the clutch had gone. He didnt ask so i didnt tell him - i described the car as it was, and he had spotted a couple of other things wrong.

he went to trading standards.
Its totally the responsabilty of the buyer to find fault with the car. The seller however cant lie as posted above.

Its dogdy ground but the general "sold as seen" does have some standing,.

Needless to say the buyer of my Calibra had to fund the repairs himself as he had no LEGAL standpoint of which to pursue.
