As some of you may know I work as an Enforcement Officer for differing High Cour Offices (im a Bailiff). We have always accepted post-dated cheques from our Defendants but recently have had several disputes with Defendants as to the legalities of post-dated cheuqes.
Some say they are illegal and im certain they wont be as I work for the Under Sheriff of Nottingham who is a judge and he would not accept 'illegal' payments. Anybody have a link to any on-line literature regarding the law and post-dating a cheque?

Yes there is a high sheriff apointed by Maj at Buckingham and also an undersheriff, the undersheriff is called Mr Bullock and im employed by him for one of my many jobs as an enforcement officer for the Derby devision of the WMG enforcement offices. - Will look tops on the old C.V

debenture - heard the word but not really familiar with these terms? Anyone explain in a simplish terms so ive got a good comback for the Defendants...

post dated cheques are not in any way guaranteed to not get cleared before the date on them

Not really sure businesses use them as a post dated cheque so a customer or liquidation firm has to wait so long for the money but they have the cheque

Writting a post dated cheque isnt illegal i dont think... However you shouldnt pay them into a bank account until the date on the cheque is reached, otherwise it will be returned. Writting a post dated cheque is good if you dont want someone to take the funds until that date

It's not illegal to write a post dated cheque - we get them at work all the time - however if the cheque is represented before the date, obviously it will bounce.

A debenture has nothing to do with cheques. In simple terms is a long term loan which pays interest to the loanee.

My dad postdated a cheque for something a while back and the bank cashed it straight away, when he queried this, he was told that postdating was simply an agreement between the debtor and the creditor, if the creditor chooses to cash the cheque before the date then the bank will honour it.
