i was in a car crash a while back as a passenger, and we were travel down a side street one of the main ones leading to town with terraced houses on it but it has unmarked junctions but the road we were traveing along cuts the other road in half with its road surface, does this mean we have priority or should both parties have give way,

ill draw a picture



RED = PARKED RANDOM CARS
BLUE = BMW COMPACT THAT WE HIT THAT PULLED OUT
SILVER = FOCUS ST I WAS PASSENGER IN
BLACK = STREET HOUSES
BROWN = SHOP WE ALSO HIT

right there the drawing basically the bmw pulled out due to restricted vison and we hit the side of the car and then continued traveling forward into the front of the shop, Im just woundering who has priority, and also the police have decided there not making any charges and are leaving the insurance companys to sort it ive made a personal injury claim will i still recieve the claim money or not, or does the insuirance have to go either way.

id say you had priority.

will most likely get settled 50/50, unless you have witnesses saying the bmw pulled out without looking.

if it goes 50/50 will i still get my claim, and if it goes against me and my friend(driver) can we still claim for personal injurie

personall injury is through the civil courts so its separate mate

but the road traffic act people say both parties should have given way, and the policewomen said she always thought we had priority just wait and see what the insurance companys make of it but we have finished our investigations and no1 will be charged

so there is no give way lane for her?

confusing as you've drawn a picture with a line cutting across the road the bmw was on.

if theres no lines or give way signs it will be 50/50

yea theres no lines or giveaway signs thats just to show the difference in the surfaces like ones old surface ones a newer one

How can anyone say you had priority? If theres no lines then theres no-one that has to stop by the book. Just cos the road surface is overlapping doesnt mean that the surface that carries on is the right of way.

Are you actually injured or are you another person bumping up our premiums for nothing?

I was always taught in my driving lessons that in that situation nobody has right of way.

Both of you should have given way, it will go 50/50. Bye Bye no claims

not my claims was my mates courtesy car, and yes i am actually injured had brusing to my stomache and do suffer from back and neck pain and i didnt notice but when i went to see him he got me to do exercizes and i carnt make my ear touch my shoulder on one side, and i have been very ohnest with my claim as to cover my own arse and i dont like to do someone for something they have not caused

well thats what the solicitors doctor said in his situation he carnt tell me to go to physio but he said it will help me getting back to normal and aparently the insurance will decide weather or not i need to see physio but he has put a recommendation to see physio on his sheet, but he also said go see your gp and they will help you with physio from the NHS
