i am away to make a claim due to my engine having flood damage and the car has been written off. the policy is in my brothers name and the car is in my name. am pritty sure when my brother took the policy out he said he was the owner of the car, do you think this will effect the claim?

Yeah its a matter of them finding out. A mate had a car registered to him but under his dads insurance policy and they found out...got a bit funny...but still paid out. I think you'll be fine

Just keep quiet and see what happens

Actually, are you a second driver on the policy of your brothers? Or are you claiming?

If you're a named driver on the policy then you shouldn't have any problem claiming

Who is your insurance company? I work part-time for directline claims. They will find out it's you that's the owner of the car if it is deff a total loss. You have to send in all docs to your insurer, driving license, log book, mot, vrd etc so they will know...it shouldn't really affect your claim too much, but strictly speaking, whoever is down as the owner on paper, should be the policyholder...so the policy should be rated on you, not your brother. But it just depends, they might be alright about it, or they may charge you an additional premium, as you should be the ph, not your brother. They deff wont knock back your claim though, it's up to underwriting to decide exactly what happens
