ok this is going to sound weird but basically i took wats known as a career break from tesco where they give you unpaid leave from 3months to 5 years to go do what ever you want then when your ready to return you will have the oppertunity to return to work depending on what positions are available.

anyways ive been off work since 16th of may and am here in texas staying with my aunt, i checked my pay slip on the 15th of june to make sure i got paid, at which point i worked 7 working days outta a 20 working day month however i received a full pay check i thought great.

just checked my account and ive been paid a full month again even though i havent worked at all, dont get me wrong im over the moon but i dont want to get back and then have them demand the money back what are my legal rights anyone know?

they can demand it back and take you to court if you refuse. You can risk keeping hold of the money in your account for now incase they dont realise and say you didnt either, but I wouldnt go spending it if you cant afford to pay it back if they asked.

well they won't be able to take it back out of your account. if anything arises from it, just play dumb and say you didn't realise.

Yeh it's iffy, they'll just ask for it back.

If not then they'll start banging on about Court, Just keep collecting it

No they can't

They can ask for it back and you can refuse, but if you do that they'll just make life hard for you at work.

This happened to my sister a month or so back.

Gary, yes they can. obviously your sisters boss went about buisness the wrong way! In this case tesco's would probably have him pay the court costs aswell if they win!. But agree to pay it back £10 a month/week what ever

well to be honest i put in enough hours which they conveniently forgot to pay me over the 2 and a half years ive worked there and on the one or two times they agreed to give me the money they owed me i had to wait till the next pay to get it.

e.g. during the new tax year where most people get a weeks pay cheque as they sort out the tax's or whatever is done over april the 1st that month i only received half my pay cheque

i just wanted to know what the rule was when this happens, i dont mind giving it back if they ask but i wont be giving it all back and i will follow the advice given above and pay them back monthly

remove it all and put it into an ISA or the like, then its gaining a little bit of interest, and if forced to give it back you have it ready to give
