hello

a mate of mine at david loyd gym has just cancelled his gym membership by handing in his 3 month notice! however he has stopped his direct debits, so no more payments can be made for the 3 month cancelling period lol!

i have not used the gym for about 2-3 months but i have handed in my notice at start of this month, but not cancelled the direct debits, i was thinking of doing the same??
but the contract that was signed says has to be a 3 month cancel period?? and that they will continue to try collect payments for the 3 months and may refer to a collection agency!

has anybody been through this or know anything about it?
or what could or will happen??

you've signed a contract saying you will pay for three months canellation.

If you dont they can claim it from you

It use to be 3 months but has now changed to just 1 month. Well my David Lloyd has, not sure if it applies to all of them though?!

I would just cancel the dd & not go back in!! Surely they cannot attempt to charge you if your not using there services!!

if its in the contract, they can take the money as its owed. You have to sign an agreement to join they tell you about cancelling at the time.

If hes just cancelled his DD they have his bank details and will claim it back lawfully!

hmm im not sure what to do, i have not used the gym for last 2-3 months, yet i have paid for it!! and now im in the 3 month cancellation period and i really dont think i will use it in next 3 months!! yet i still have to pay because i only handed in the notice this month!

i guess its the principal that counts though, im just worried what will happen if i do cancel direct debit and not go back! do you think they will just leave it at that considering my situation and that i have not used their services in long time???

If the direct debits removed then the bank will not let them withdraw any funds!!

If so hell get a nice letter from debt collection companies in a few months. If you sign an agreement/contract you are bound by the terms, if they say you have to pay 3months DD then you do.

yup was gonna say they will send it on to a debt collection agency, then again they might not so just cancel it and dont worry about it unless they contact you about it, if they contact you then pay it.

cancel it anyway....
they will ask you for it before sending round debt collection I would think...
if they do, just say it was cancelled by accident and pay up

oh and ive heard its changed to a one month cancellation period as of now??
or is this for members who have been their for over a year??
would it apply in my case as the first month of cancellation for me is december??

I did the same, cancelled direct debit and fought David Lloyd. My partner did the same. Mention unfair contract terms and say you'll challenge it. I had to pay 2 of the 3 months and she didn't have to pay anything.

Apparently a lot of people have complained and I would be surprised if the con merchants change the terms. IMO its a fucking piss take to ask for another 3 months.

I work for David Lloyd.

It is a 3 month notice period at our club? You will get hassled by a debt collection agency if you go into bad debt. Its all written in the contract that you've signed. Might be worth arguing it til your blue in the face. Say that you cancelled it 2 months ago by post and haven't been coming because you thought it had expired.

If you are prepared to pay it (the sensible option) just downgrade your membership for the final 3 months to offpeak.

i dont know anything about a off peak option!!!!

all i was told was its a £63 monthly fee for full unlimited access!??? which has now changed to a ridiculous £68, and ive heard its going upto £75 a month next year

how much is the off peak? does the prices and options vary from different branches or somthing??

can i still change to off peak for the final 3 months and whats this about the new 1 month cancelling period, if so would i still be eligible??
