If it supposedly passes emissions and isnt making a really loud noise is it an MOT failiure?

The reason i ask is my GF bought a car from a dealer 4 weeks ago, yesterday she had to replace both front tyres, and at the same time was told there was a largish hole in the centre section.

Now this garage we bought the car from put a fresh mot on the car at time of purchase, there is a warranty with the car, but im not sure if it covers the warrenty.

If the garage try to say they wont fix it do you think i could play the card that they mot'd the car 4 weeks ago with a hole in the exhaust therefore they have been performing illegal mots and if they dont put it right i'l report them on top of that i could add the tyres themselves mustve been illegal aswell as the one was very bald, no amount of driving in 4 weeks could amount to that tyre being legal 4 weeks ago

I would say a largish hole in the exhuast would constitute an MOT failure.

it cant hurt to go and talk to them, but if they do the work hang around and make sure it gets done properly!

yes i think i need to ask the plae that found it wether the hole would place the exhaust in a situation where it could break off.

I think if the garage is advertising there cars with a new mot then you should expect the vehicle to be in roadworthy condition, i dont class 4 weeks after buying the car and the exhaust is falling off as roadworthy!

Do you think i have a point if i come back at them and say that the car you passed 4 weeks ago was unroadworthy, either sort it or we'l report you?

I don't think it's a fail as long as emissions are OK?

correct..

i thought it would be if the hole as large enough to threaten the exhaust snapping in half or summti, surely that would be classed as unsatisfactory general condition of the motor vehicle

so do you think if ATS confirms the exhaust will snap off soon if its not fixed its a failiure?

Warrenty's do not cover wear and tear parts, therefore the tyres if they were illegal and if you (or whoever got the car) didn't pick up on this, they will not change them unless they do it as a good will gesture, unfortunatly, I also believe the Exhaust isn't covered but you may want to check

yes i am aware tyres arent covered under the warranty, but the mot shoulda picked up on them, if they passed the car with illegal tyres they are breaking the law, and i can use this to twist there arm to put the exhaust right

I had a smallish hole in my exhaust (before it was stainless) and it failed...

Wasn't particularly loud at all -- just make the 1.2 sound less of a hairdryer...

When I was in Slough last saturday I was at the Shell servo getting some petrol and some kid with a silver 1.0 12v Corsa B was in there, he had a very loud stainless system (straight through I reckon), man did that car sound shit!

A Nova would have sounded better!

General > Exhaust System
Reason: Exhaust Centre Silencer Holed & Blowing

it has to be quite excessive to fail but the reason is gases getting in to the compartment and gassing you
