Basically, i was stopped while leaving a public car park by a policeman earlier and he informed me that it was private property and said that if my car is seen up there again it will be confiscated (sp) and crushed.

Now this car park is on the roof of a few shops with another car park down below in front of these shops. It has some gates as you go up the entrance, but they have never been locked at night. Both parts of the car park are privately owned, so i can only think that its the gates that make the top area 'out of bounds'.

All i really need to know is under what circumstances they can confiscate my car and crush it bearing in mind all we were doing is sitting up there chatting.

I know this is a bit of an essay, thanks if u have read it and cheers in advance for any help !!!

Im afraid they do have the power to seize your car and have it crushed.
In the criminal justice and public order act 1994, section 62 (Supplementary Powers of Seizure) it states under subsection 1b:
entered the land as a trespasser with a vehicle withing the period of 3 months beginning with the day on which the direction was given, the constable may seize and remove that vehicle.

we have NO tresspassing laws in Scotland, it makes thing a bit confusing sometimes

there are some silly laws about in England.

How about where if you leave your front door open any stranger can wonder into your house and do as they please and they can't physically be removed

In theory yes they could as technically they are doing nothing wrong, somebody could set up camp in your back garden and it would be difficuilt to have them moved

It can get quite complex and boring after a while
