Yeah, that's a point. Can't your insurance company come out to assess your car, realise the amount of damage to yours wouldn't result in any whiplash on the victims part?

If you have legal cover included, i would argue the fraudulent claim issue.

just beware the fees will no doubt be added to the claim if you lose

I have been advised by a mate with a lawyers degree etc. That i should do the following...

NOT give over my insurance details (as the companies will most likely liase with eachother resulting in me gettin F'd!

Write to the solicitors stating i am unwilling to give over my insurance details because i feel that I am not the one responsible for the accident, and the lack of damage to our vehicles could not have resulted in their clients whiplash. And to say that i can provide evidence to this effect.

He then said they will more than likely write a letter claiming damages at which point he shall tell me what to do. But he said that they SHOULD realise the guy is making a fraudulant claim and realise that they would not be able to get anywhere with it.

The only reason he said this should work is because the guy has absolutely no evidence of me crashing into him and the damage that was caused....

Currently writing a letter now so fingers crossed
