For an MOT test the car does NOT need to move, they do not check anything that requires it to move.
so they should not have been driving it at all. Also the car was in their posession, and they self evidently caused the damage.
Legally speaking they have to pay for the damage caused, you can ring trading standards but i forgot the number sorry!

When they were MOT'ing my golf, i was on the A41 and it went past me at about 130 when I was at work in an unmarked T5 
Oh yes, they got severly bummed 
Always something to be careful of, especially with quick modified cars and MOT testing stations
I had the same with my Astra, my brother phoned me to say my carr had overtaken him at about 100 on the local bypass, luckily i knoew it was my usual mechanic driving it, he does rallies so i knew it was in safe hands

get as much evidence as in pics before it went in there!!
wot garage did it happen at as i know alot of the places in northampton and sum of them are very dodgy!
my advise would be to do it the right way and go through the police if neccesary!
tell the insuance company it has happened and they will help u as much as they can!
that is what they are there for!

if the dents in the roof were caused by them, they have to fix aswell, dont let them get away with that aswell, i will be fuming if you let them get away with the dents in the roof if they caused them too

as everyone else has said, the garage should definately sort it. Hope it all turns out okay in the end though Im now looking forward to getting the emerald ecu so i can set the rev limit to 3k when giving it to garages

Update... The garage has fixed the windscreen, but as of yet they are still 'trying' to find a bonnet the same as the one they broke on my brothers car, but still, they won't touch the dents!!

Yeh, they caused both of them when the bonnet flew up. It isn't me sortin it out, its my bruv, and he says that he will see how he feels when they have fixed the rest of the car.

To be fair, the dents aren't as bad in real life as in the pix. They have managed to fix the windscreen and the washer panel, and are ordering a bonnet for him, so i think they are trying to sort it out.

At any garage before any MOT is carried out they must first write down the car detail this also including the VIM number and this being under the bonnet so your brother is 100% not to blame
See what they say to that.
