TBH as far as i know we're in the wrong by the law. as i said, if someone was to leave our pub drunk and put a window out on the shop next door, we'd be to blame, think this works in same way as we let the guy be over the limit....

we dont know yet, as i said pub manager has been in meetings all day, hes not back in work until tomorrow.
last time out cctv was taken by police was when a huge scottish bloke pulled me over the bar after accusing me of not putting vodka in his drink

I don't get it that surely means that you can only sell anyone on the premises one drink maybe two depending what it was to make sure they didn't go over the limit just incase they decided to drive.
I can understand being responsible if you get some people blind drunk and lairy who g smashing windows but the drink drivin.

If this is the case then surely if someone bought a litre of vodka from a shop, got wrecked then smashed into a house, the person who sold the drink would be held responsible? I can't see anything coming of this.

LMFAO this would be thrown out in seconds, no way would this get taken to court. Any normal person would make a monkey of the CPS. Your original post states it is because someone was stopped for drink driving, they cannot be held liable for that.
Liability in criminal and civil law require the accused to have caused the result of which the plaintiff complains. They may have served the drink but they did not pour it down their throat, nor did they throw them the keys to their car. 
Then you get onto the actus reus (guilty act) and mens rea (guilty mind) of the event and both would have to be present for criminal liability to be proven.
Both of those can very easily be proven for the drink driver though. Guilty act is proven as they have shown as positive. Guilty mind is proven as they have driven.
Further more if this was only a few days back you want to do some digging, sounds like something else has gone on as well. Plus the driver may yet not be prosecuted for drink driving. They get tested at the road side and if they blow in excess of 35mg they will be arrested and taken to the station where they are tested twice on a seperate machine. On the seperate machine you do 2 samples, they take the lower of these 2 as your rating. On the lower of the 2 ratings if you are under 35mg you are released, if it is between 36 and 50mg you are given the option of a blood test, if it is over 51mg then your fucked! Plus with the blood test the parameters change slightly as your are dealing with fluid rather than gas. The blood test must be below 80mg, however the police generally deduct 6mg due to analytical variences.

was staff night out last night, member of staff in question is still suspended, had disciplinary with area managers and is kept suspended until police sort it out, thats all we know. our CPS is meeting with police this week
