Yeah you're probably right but essentially you picked up the guys phone when you could have easily said to him that he had dropped his phone.
Secondly, you then sold the phone for £70 AND used his sim card which knowingly costed him probably quite alot of money and go on here to brag about it. Ok, he should have barred his phone as soon as he realised he had dropped it, but most people with a conscience (sp?) would have never done the above anyway.
