if somone sells' x' as 'x', but it turns out to be 'y', then this is 'misrepresentation' under the sale of goods act. legally you are entitled to give it back, and be refunded the money you paid, minus wear and tear (probably only really applicable if you've had it for a good while). local trading standards will fill you in better than i can, but hope this helps.

if it is advertised as something but in fact it is somthing else then your entiled to a refund. no ifs or buts

However I part exchanged my Ibiza agaisnt this? so how would a refund work?

Shouldnt affect it really, your not wanting to give the car back....only to pay for what you have bought ie. few quid back your way!!!

No he was mislead by a trader who had it advertised as a MY00 STi5 when its actually a MY98 STi4............misleading advertisement, ebay and posts on the net!

HPi check would not have shown the model type, the V5 itself just says subaru impreza. which means sod all, could be a N/A family version

small claims court is a waste of time, if you won, all he would be told too is pay you, they cant inforce it however.

just small claims court. best thing too do would be visit trading standards and take your proof with you.

If he believed it was a sti 5 then has he done anything wrong.
