It's not a defence, you can still be done.

I drive through lights in this situation but I know its illegal and I'll probably be done for it. Another example of illogical road policing.

I wouldn't move. I stayed put the other day and I'd do it again, I know people who have ended up with points for following the highway code, I'd rather not fall foul of this ridiculous backwards loophole TBH.
