that looks like it could have been alot worse, be glad your still in one piece after that. A new wing and a headlight and it will look good as new pal

Not really. I could be argued that the Micra was present in a position straddling both lanes and the Corsa has approached behind and struck him without attempting to slow down.

Ultimately, there's loads of evidence to say that the Corsa was travelling towards the back of the Micra but absolutely nothing whatsoever to say that the Micra was moving sideways in to your path.

Witness statements MUST reaffirm the fact that the Micra had entered the path of another vehicle while in such close proximity that even after slowing down or taking advantage of additional space in your lane to the best of your ability that a collision still resulted.

If that were me in the Micra, I would argue that I was already there and had been for miles and the Corsa, travelling faster, struck the rear of my vehicle. This would result in the Micra being unable to prevent a collision and therefore not at fault.

Make sure witness statements prohibit this!!

Ian does have some good points.

I had an accident like this myself earlier in the year. A lorry driver pulled out without allowing ample room (nation speed limit road with two lanes - i was doing 60 and he was doing about 30) and i couldnt avoid the back of him even with braking as hard as i could. However, i still hit the rear of the lorry so i'm in a world of joy trying to prove it wasnt my fault the accident happened.

I did even have a witness but because the witness is dragging their feet and there statement was 'lost' once the claim is going no where fast.

So far its been over 6 months since my accident and its not sorted. Doesn't help hes a foreign driver either!

This is where i was quite pleased (well not really lol) but i have pictures of everything, even showing my skidmarks and you can clearly see that he has pulled out in front of me, and also the skidmarks arent long enough to show that i was speeding. As said before the actual front end damage to my car would suggest what happened

And with regards to witnesses, i can safely say that a drive of a red MPV saw clearly what happened but decided to just sail straight past without stopping... Cheers!

Can't be compared. Bikes are a lot more responsive, a slight blip of the throttle can get you out the way. Same as the brakes are much more repsonsive and the slighest tap can knock dozens of mph off in an instant.

I ride down one of the busyest motorways into london in rush hour every day. You will learn as you ride what to look out for as it becomes blatently obvious how crap the driving is in this country.

Its harder avoiding twat head pedestrians at 30mph than it is avoiding idiotic cars at 80+mph.

that is soo true, it is unreal how much times i have to swerve or brake on a daily basis to avoid car drivers just not having a good look and dont see you coming etc.
