If it goes to court, depending on your income your looking at £100 fine, £40 CPS Costs, and 6 points.

costs arent usually a great amount for something like this

i failed to pay an SP30 and it went to court, the end result was 3 points and £60 fine +costs which amounted to £80 in total

was happy when i got that

it says there they give you the option of a fixed penalty, if you accept then they give you £60 fine and 3 points, if not you'll go to court. am i missing something thats making it more difficult to understand?

the part that confused me was where it says "you will be considered for a fixed penalty"...does that mean they consider whether to give me one or not OR does it mean i get to choose whether to pay the penalty or contest it in court

Wrong, This has been through the Courts. Section 172 of the Road Traffic Act requires the registered keeper of a vehicle to tell the Police who was driving the vehicle at the time a road traffic offence occured. This has been held NOT to infringe peoples human rights. There is no requirement for a caution as they are not interviewing you simply asking you to provide a piece of information which you are required to by law.
