i was sold something that wouldnt feasibly work on the application it was designed for, and my patince with this situation is wearing thin, i expect a full refund for the goods and unless that is met i will be forwarding your details to the police with regards to copyright infringement.enough is enough, i run a business and dont have the time to deal with paopel clearly not in the same situation as myself and seem to spout forth about things they clearly know nothin about. a full refund within 24 hours or i contact your local police and ebay.

What about sending something like......

"In the advert, it clearly stated what you needed to get the item to work. Therefore, if the item does not work due to you not having the required firmware, it was your responsibility to check. After all, you don't buy a bit of software which says "Windows XP only", if you've got Windows 3.1 to then find out that it doesn't work do you?

Regardless, the advert was withdrawn from eBay and you chose to purchase said items outside of eBay. Therefore, eBay will not be able to help. However, should you feel the need to contact them, I will also contact them to state that you offered to buy the items outside of eBay, which is also against eBay rules.

Might I also advise you that by buying the so called copyright infringing items, you are also an accomplice and I will also report you for buying and selling copyright infringing items, as that is also an offence.

However, to summarise, GTF.

tell him to send back the item. He will probably send it 1st class and claim you have not received it, so cannot refund him. He will not be able to report you if he doesn't have the evidence in hand.

I have written a reply: -

The item I sold you DOES work, you should have read the advert clearly, therefore that is not my problem. I stated in the advert that the disc would require firmware 1.0 - 1.5 to work, you should of checked your firmware before agreeing to purchase said item, which may I add was bought out of eBay, which is AGAINST the rules of the site.


You bought the CD knowing full well that it was copyrighted material, therefore you can get into trouble aswell for "copyright infringement".



As far as I am concerned the matter is closed, if you continue to contact me, I will have no other alternative but to report you to the Police.

I have a good idea, that is a bit of an improvement on Abdus' idea. Tell him to send it back, but give him an address that doesn't exist i.e. a number about 50 higher than the highest in your street and a slightly wrong postcode.

It should get to you, but you can claim it hasn't. When he goes to put a claim in with RM, we tell him he's used the wrong address and he gets nothing

Email him back with something along the lines of what dan posted, he hasn't got a leg to stand on, not with ebay for purchasing outside ebay nor the police as he is also accomplice with paying for copyrighted software (which is clearly obvious).
Oh and if he passing your information on you will seek legal advice of breach of data privacy act.

And like said, the advert clearly stated that he needed firmware versions 1 - 1.5 (you have followed the UK Distance Selling Regulations) and it's up to him that he should check this as it's completly utterly fucking impossible that you would know the version of firmware running on his particular PSP.

And he is also blackmailing you, which is also an offence

I don't think the breach of privacy act would apply here, for the simple reason that how would you go about grassing on people to the police, if they were at risk of breaking data protection laws?

These are the facts:

The item you bought DOES work.
Your responsbility is to read the advert clearly and ensure you have the correct firmware 1.0 - 1.5.
The firmware requirements were clearly stated in the advert.
You are responsible for checking your own firmware before agreeing to purchase.
You contacted me outside an EBay auction - which is against the rules of the site.
You bought the CD knowing full well that it may be copyrighted material, therefore by reporting me you are also implicated if this material does happen to infringe copyright (although because of the ages of these games and the amount you paid, do you really think anyone will be interested?)
If you had been more polite and not acted in such a threat centred way I might have considered your request.

As far as I am concerned the matter is closed, if you continue to contact me, I will have no other alternative but to report you to the Police (under the Protection from Harassment Act 1997).

I will not enter into any further communication with you.

i have to say that i very much appreciate your work, and i am very much impressed with your reaction, in fact almost blown away with the business like manner that u deal with such a threat like my own!!! for the sake of a tenner im more than lettin it go, but really feel that there is more than one person replyin to my emails and the brighter half should distance themselves form the lesser. i run a business up here that ammasses more than 2 million pounds a year and have yet to see someone act with such balls. very much cool with losin a tenner, and wish the better of u lot all the best, if you even feel the need to find a career writtin contarcts give me a shout, we always like people who dont take bullshit
