yes i understood the point about crossing the road. If the man walked out giving Khan no chance then he can not be aportioned any blame.
However if the media are led to be believed "cough cough" that he could have prevented the injury had he been driving within the law. Whether it be driving without due care or otherwise Then i am afriad he must accept the blame for his actions.

And you accept blame/liability/guilt ONLY when you are at fault..This has to be proven (beyond reasonable doubt)
