LOL how can you 'SUE' someone, under for the computer missuse act.
Let alone for breaking a TOS which is not official. So he used someone elses password, its not like he rofled your gibson and caused any damage to any property virtual or real.

I think the precident was set a little while ago when the site owners were succesfully sued for slanderous remarks made on a forum

yeah, a precedent has been set and there is a case against him imo since he got into somebody's account without authorisation, used that to make unnecessary abusive messages..that would mean infringing privacy of the space of the victim in the first place...then everything follows

If somebody, whether logged in as themselves or someone else, comes on here and posts something detrimental to my wellbeing....
I can Sue Ian for damages.

I dont think damages would come into the equation tbh...as said above Lee is a man of straw, so no monies available.
A successful case may see Lee having trouble getting an ISP though IIRC
