ha, ive been told the same thing, it is supposedly true... same goes with traffic wardens, if they are not in full uniform (i.e not wearing a hat) then they can not legally issue a ticket....??? any police on here shed any light?

For the purposes of police officer, if you are adequately dressed so that you are recognised as a police officer, then in the eyes of the law, you are a police officer. If you have any part(s) of uniform on which would suggest you are a police officer, then that is good enough. Not wearing a hat makes no odds.
P.S. It is an urban myth regarding hats, ties etc, the following saying comes to mind: if it looks like a duck, quacks like a duck, walks like a duck, swims like a duck, what is it?

I dont think you can complain really, hes only doing his job. Maybe he could have been a bit more polite but your car would look better with standard plates on anyway.

well then it would make sense to change the precedent then. Maybe a case did happen like that but you can guarentee that they changed something to rectify it shortly. What people are fogetting is that magistrates haven't got a fucking scooby doo. The girlfriend was at the magistrates court the otherday with her law class, a guy got a 40 quid fine for no insurance/tax/or licence. He was already banned from a prevoius time and had no licence in the first place anyhow. It's a joke.

the Divisional Court ruled in Wallwork v. Giles (1970) 114 S.J. 36 that "a constable who is wearing his uniform except for the helmet is "in uniform" within the Road Safety Act 1967 s. 2 and therefore entitled to demand a breath test, at any rate if the other circumstances are such that the driver can easily identify him as a policeman

Costs thousands to be legal and you get a 40 quid fine for having nothing.

Yes as said magistrates are a joke, htere were some other cases not motor related that she said they only got 40 quid fine for. Just think of all the costs they rack up, police time, court costs etc and they walk out owing 40 notes.
